As school starts back up this fall and more child pedestrians are present on our roads once again, the issue of pedestrian safety increases in importance.
AAA recently offered a number of safety tips to both parents and motorists to help keep children safe. Keeping these tips in mind will help raise awareness of the issue of pedestrian safety at the street level. These tips include things like staying alert, being mindful of bicyclists, and keeping an eye out for children at intersections. Many of the tips are common sense actions drivers should be doing anyway, such as slowing down in school zones and residential areas, stopping for school busses, obeying traffic signals, and so on.
Drivers, of course, are expected to exercise a degree of caution appropriate to the circumstances. When negligence is the basis of personal injury litigation, this is the general standard that is used. When motorists fail to take basic care and harm a pedestrian as a result, the victim and his or her family have the right to hold the motorist accountable.
When pursuing personal injury litigation, it is important for victims to work with an experienced attorney for a number of reasons. Personal injury cases, to be effective, require not only a solid liability case, but also a strong damages case. Without a strong damages case, the payout of litigation may not be great enough to justify the time and effort spent litigating. An experienced attorney, though, can help an accident victim to present a strong case on both front and achieve the best possible outcome in their case.
